Note on Medical Necessity

While physicians must be able to order any test which they believe is appropriate for the treatment of their patients, they must be aware that Medicare, Medicaid, and other federally funded healthcare programs will only pay for services that are determined to be "reasonable and necessary" under section 1862(A)(1) of the Medicare law. The Office of the Inspector General takes the position that any physician who orders medically unnecessary test to be billed to Medicare/Medicaid may be subject to civil penalties for fraud and abuse. Physicians must be advised that they should only order those tests which are medically necessary for the diagnosis and treatment of their patients when reimbursement will be sought from federally funded healthcare programs. All orders for screening tests on Medicare/Medicaid patients must be accompanied by an Advanced Beneficiary Notification.
